The Plainview News reports the case is centered on an incident in which a student allegedly airdropped an explicit photograph of a 14-year-old victim to fellow students in the school cafeteria.
The victim was unaware that such a photo had been taken or shared.
According to court documents, from 2021 to 2023, a male teenage student faced persistent and severe bullying from a classmate.
The behavior was described as "unwelcome, severe, and pervasive," including threats of bringing a gun to school to harm another student. The lawsuit notes that the bullying became so intense that the victim considered suicide.
The lawsuit, filed by the victim's family, accuses the School District of violations under Title IX and the Minnesota Human Rights Act, along with negligence and denial of equal protection and due process.
In response to the explicit photo incident, the school issued a one-day in-school suspension to the perpetrator, gave a verbal warning, and banned phone use for the remainder of the semester.
Three days after the incident, the same student reportedly taunted the victim in the cafeteria about the photograph.
The school's alleged response was to instruct the bullying student to avoid contact with the victim.
